A federal workers union is suing the Trump administration for inserting language into Department of Education employees' out-of-office email messages blaming Democrats for the government shutdown.

This claim is true, The American Federation of Government Employees (AFGE) is currently filing a lawsuit against the Trump-Vance administration due to out-of-office emails going out using partisan political language without workers consent. The website above also uses a direct quote from the AFGE President which explains the use of workers emails without consent. This is a violation of the First Amendment and forces workers to become "political mouthpieces against their will" (AFGE). Other newspapers including The New York Times and NBC have written about this lawsuit. They also share familiar quotes from the same sources and from people directly involved.

True, the AFGE (American Federation of Government Employees) did in fact file a lawsuit against the U.S department of education. Reason being, the U.S department of educations out of office emails during a past shutdown was strategically worded to blame the senate democrats without them knowing. They claimed that the democratic senators were "blocking passage of H.R. 5371 in the Senate, which has led to a lapse in appropriations." (Fedscoop). This violates the Hatch Act which is supposed to prevent the federal employees from being used as political tools which this does.

This claim is true, The American Federation of Government Employees sent a cease-and-desist letter as well as filed a lawsuit against the U.S. Department of Education. This lawsuit comes from the Trump administration changing out-of-office email language to blame the Democrats for the government shutdown. The AFGE said "Forcing civil servants to speak on behalf of the political leadership's partisan agenda is a blatant violation of federal employees' First Amendment rights," (ABC). These language changes also bring in the question of whether or not this infringes upon The Hatch Act (Washington Examiner).

While the source of NPR does reflect these findings I looked into more sources to verify the statements made. I looked into both ABC News and the Washington Examiner in order to try and avoid possible bias and found that both stories found the same conclusion that NPR did.

I thoroughly enjoyed how straightforward the User was in fact checking the claim. They began by asserting that the claim was true through the use of their sources, such as “the American Federation of Government Employees sending cease and desist letters to the U.S. Department of Education”. They stated that “forcing civil servants to speak on behalf of the political action leadership’s partisan agenda is a blatant violation” This helps to engage the reader.

This is true. The American Federation for Government Employees, or AFGE, put out an official statement saying they are suing the Trump administration over allegations of partisan language being inserted into their members automatic email replies during the government shutdown. The posted source, NPR, links to some court filings and related statements, but not directly to the unions official announcement. I have included the unions official announcement and two other articles referencing it below.

The American Federation of Government Employees (AFGE), the largest federal employee union, filed a lawsuit on October 3, 2025, against the U.S. Department of Education, alleging that the agency replaced employees’ out-of-office auto-reply messages with partisan language blaming Senate Democrats for a shutdown without notifying or obtaining consent from the employees.

From my research, this statement is true. 

From the American Federation of Government Employees, of AFGE, website (which is linked below), as of October 3rd, 2025, the AFGE did in fact file a lawsuit against the Trump Administration, specifically the Department of Education, for sending out emails with automatically added partisan language without the consent of the workers. The AFGE president, Everrett Kelly states that this action "blatantly violates the law in yet-another assault on federal workers' rights". The AFGE states that the unknowing addition of partisan language into emails violates the workers' First Amendment Rights, impeding on their freedom of speech and belief. For this claim, this primary source is unbiased when it comes to answering if this lawsuit is actually happening, though still in favor of federal workers' as it is the official federation of government employees. While looking through this source, I also found the official complaint file (also linked down below) of this lawsuit. The first sentence of the complaint that states why this complaint is made, "To blame its political opponents for the federal government shutdown that began on October 1, 2025, the Trump Administration has gone to extraordinary measures to leverage its control of federal agencies", immediately backs up the claim that this is against the First Amendment Rights of workers if it is true the Trump Administration is tying beliefs to non-consenting individuals for leverage. 

While these sources may be biased toward the AFGE as they come from the official website like I stated before, when it comes to if this claim that a lawsuit was filed is true or false, these websites are not biased and state that this is true. The reasoning will be biased in favor of the workers' affected but overall, the fact that a lawsuit is presented is confirmed

This is actually true after scouring the internet for many reliable articles, such as  ABC NewsNational Public Radio, and other websites, all of which similarly claim that the trump administration has committed ethnic violations during the government shutdowns. ABC News states, "The Trump administration committed ethics violations at the beginning of the government shutdown by providing politically charged out-of-office email replies for government employees,"   while NPR helps verify this statement by stating,  "A federal workers union is suing the Trump administration for inserting language into Department of Education employees' out-of-office email messages." both articles go over the coming on going investigation between the department of education and the trump administration for violating federal employee first amendment rights.
