Yes, they could be held responsible. This depends on of the death of the firefighter was 'preventable'. Often the fire department will provide compensation to the family of the firefighter through Workers' Compensation but if the family believes there was negligence involved such as insufficient training, or improper gear (which it seems there wasn't in this case) then they could seek legal action.
