This is misleading. The laws in New York state that you can get an abortion up to and including 24 weeks of pregnancy. After that, you are allowed to get an abortion only if your health or pregnancy are at risk. So, yes, abortion is allowed up until birth, but you need to meet certain requirements to do so.

The claim that New York allows abortions up until birth is both true and false. You can get an abortion up to twenty four weeks of pregnancy regardless; however, when it comes to up until birth, you must meet one of the requirements. The requirements say that the state of New York allows abortions up until birth if only the fetus is "not compatible with life" or that the pregnancy causes serious harm or implications to the mother's life.

This is partly false. According to "NYC Health" abortion law in New York is that "you can get an abortion for any reason up to 24 weeks of pregnancy, or later if your health is at risk or your pregnancy will not survive" (Link). This meaning that it can happen after but only if there is an inherent risk because of the pregnancy. The claim is misleading because the only way an abortion will actually happening after 24 weeks or "up until birth" is if it's at risk of harming the mother or if the fetus is no longer viable. This claim is simply misleading in a very dramatic way in order to prove a point. It is taken out of context as proven through both of these sources.

The statement has been exaggerated to make an emotional impact on people. According NYCLU you are able to get an abortion up to 24 weeks after conception. This is equivalent to 5 1/2 months. There are however special circumstances that allow for an abortion up until term. These were what the above comment failed to mention. According the a document provided by the NYCLU, the only time you can get an abortion up until term is "when the fetus is non-viable" or it possess major risk to the mothers life. This is the law that New York has in place. They are special cases. Not just anyone can get an abortion after 24 weeks, which is what the comment is implying. And going off his comment. He is saying "unborn human beings" yet if the fetus is not viable it would be still born at term. This is not true. According to the nyc.gov website, abortions are available until the pregnancy is 24 weeks. After this, then it is only available if it is necessary.

This is misleading. According to this PDF from the New York State Attorney General, abortion is legal up to 24 weeks from the start of the pregnancy. However, there are exceptions. If the pregnant person's life or mental health are at risk, or if the fetus is not viable. So, it is true that New York allows abortions up until birth, but only under strict circumstances.
