This statement is false. According to CNN, "A provision of the 14th Amendment, which was approved after the Civil War, says any American official who takes an oath to uphold the US Constitution is disqualified from holding future office if they “engaged in insurrection or rebellion” or have “given aid or comfort” to insurrectionists." However, it wasn't clearly defined how this would apply to situations which led to debate over whether Trump was illeligble or not. According to The New York Times, a professor named Steven Calabrassi, made the statement that under the 14th amendment, Donald Trump was ineligible to run for president and his name could not consitutionally be put on the ballot. However, after making this claim he quickly reversed it because "...a technicality in the drafting of the disqualification clause of Section 3 of the 14th Amendment, the clause does not apply to Trump," said Calabrassi according to The New York Times. This is an ongoing debate and no definite decision has been made.

Good evidence and sources are utilized here. You could delve deeper into whether or not Donald Trump has "engaged in insurrection or rebellion" or has "given aid or comfort" to insurrectionists. I would suggest using the Constitution and its clauses—particularly those within the First Amendment—to determine if Trump is indeed considered an insurrectionist in the eyes of our Constitution and Bill of Rights, which serve as the primary sources for all things concerning the functioning of our nation's government.

There is no better way to fact-check a claim than to examine the primary source itself. There's no need to rely on CNN or the New York Times in this case; interpreting the Constitution and amendments can be done directly from the source
